These Terms and Conditions (“Agreement”) constitute a legally binding agreement between Full Send Golf (“the Company”, “we”, “our”, “us”) and the person or corporate entity booking our services (“the Client”, “you”, “your”). By completing a booking and making payment via our website, you unconditionally agree to be bound by these terms.
1. Booking, Payment, and Fixed Fees
1.1 All bookings must be completed through our website.
1.2 Full payment of the package fee (e.g., R6,000.00) is required upfront via our secure online payment gateway (YOCO) to officially secure your chosen event date and time slot. No dates will be provisionally held without full payment.
1.3 The payment amount is fixed, locked, and fully non-editable by the Client.
2. Strict Venue, Space, and Power Requirements
The Client bears sole responsibility for ensuring the designated venue meets the strict physical parameters required for setting up the mobile simulator tent and tracking equipment.
2.1 Physical Space: The Client guarantees a completely clear, flat setup area measuring a minimum of 5m wide, 10m long, and 3.5m high.
2.2 Setup Surface: The Client must specify the surface type during booking. If setting up on soft grass, the Company reserves the right to anchor the tent using ground pegs. If setting up on hard surfaces (paving, tar, tiles), the Client must notify us so appropriate weighted ballasts can be brought.
2.3 Power Supply: The Client must provide access to a stable, dedicated 220V standard South African wall plug outlet within 30 meters of the setup location. We do not run our sensitive tracking hardware off unverified or fluctuating portable power sources unless explicitly agreed upon in writing.
2.4 Failure to Meet Requirements: If the Company arrives on site and the setup is impossible due to inadequate space, improper surface, or lack of stable electricity, the booking will be immediately cancelled, and no refund will be issued.
3: Severe Weather & Safety Closures
3.1 Company’s Right to Intervene: The Company reserves the absolute, exclusive right to suspend operations, deflate/breakdown the tent, or pack away electronic tracking equipment immediately if weather conditions deteriorate or pose a safety risk. This includes, but is not limited to: heavy rain, lightning/electrical storms, hail, or high winds exceeding 25 km/h.
3.2 Pro-Rata Weather Adjustments: If an event is cut short or forced to shut down early due to severe weather, the Client will not be entitled to a full refund or a full free reschedule. Instead, a pro-rata refund will be issued based strictly on the remaining unused time, calculated using the package’s base hourly rate.
For example: If an 8-hour package costing R16,000 is shut down after 7 hours of operational time, a refund will only be issued for the single (1) remaining unutilized hour (i.e., R2,000).
3.3 Pre-Event Cancellations: If an event is cancelled by the Company due to severe weather before any equipment setup has commenced:
The Client will receive a full refund, less a R1,000.00 operational deployment fee to cover our travel, fuel, and staff logistics costs if we have already arrived at the venue; OR
The Client may choose to reschedule the full booking to an alternative available date within 6 months, free of charge.
4. Strict Operational Rules & Equipment Safety
To protect our premium tracking technology and golf gear, the following rules apply strictly throughout the duration of the rental:
4.1 Maximum Occupancy: Only one (1) person is permitted inside the simulator tent enclosure at any given time. No spectators, children, or crowds are allowed inside the swinging or tracking zone.
4.2 Consumables Ban: Absolutely no food, alcohol, or liquids of any description are permitted inside or within 2 meters of the tent structure, simulator screen, and tracking electronics.
4.3 Right to Remove Gear: We maintain the absolute right to instantly confiscate and remove our golf clubs and balls from the venue if any guest or user displays reckless behaviour, abuse, or disrespect toward the gear.
4.4 Right to Terminate/Breakdown: We maintain the absolute right to shut down the entire experience and completely dismantle the tent structure before the booking hour limit expires if our on-site staff deem the crowd behaviour dangerous, abusive, or in direct violation of these rules. In such instances, the rental fee is entirely forfeited, and absolutely no refund will be provided.
5. Client Liability and Damage Waiver
5.1 Liability for Damage: The Client assumes full financial liability for any damage, loss, or vandalism caused to our tent structure, simulator screens, tracking technology, or golf clubs by the Client, their guests, attendees, or invitees during the rental period.
5.2 Replacement Costs: If gear is broken due to negligence or malicious misuse, the Client will be invoiced for the full retail replacement value of the damaged item plus any courier or rapid-import fees incurred by the Company.
6. Disclaimer of Liability & Indemnity
6.1 Assumption of Risk: The Client acknowledges that swinging golf clubs in an enclosed environment involves inherent physical risks.
6.2 Indemnification: The Client hereby indemnifies, defends, and holds harmless the Company, its directors, employees, and agents against any and all legal claims, injuries, damages, personal losses, deaths, or property damage suffered by the Client or any of their guests arising from the use of the simulator setup, regardless of cause.
7. Geographic Limits & Cancellation Policy
7.1 Service Boundaries: We strictly operate within our listed approved cities in Gauteng and the North-West. If a booking is made outside these zones via fraudulent dropdown selection, the booking will be cancelled immediately.
7.2 Client Cancellations: If you cancel your booking for any reason other than severe weather:
More than 14 days before the event: 100% refund.
Between 7 and 14 days before the event: 50% refund.
Less than 7 days before the event: 0% refund (100% forfeiture).
